Terms and Conditions of Sale

1. Purpose
These terms govern the sale of the products and services offered on matcheur.com: strings, racquets, grips, handles and accessories, together with workshop services — stringing, customisation, repair and paintwork.
Placing an order means accepting these terms in the version in force on the day of the order.
2. The seller
matcheur.com is operated by Vincent Leroux, sole trader (entrepreneur individuel), trading under the business name TEN'ART and the brand Matcheur.

3. Products and services
The essential characteristics of every product and service appear on its page. Photographs and the renderings produced by the site's modules are indicative: strings and frames are manufactured goods whose colour and finish may vary slightly between batches.
Setting values — mass, balance, swingweight, tension — are achieved within the tolerances stated on the relevant service page. A stated tolerance is a commitment; the absence of a stated tolerance is not one.
Our products and services are available to consumers and to businesses alike. Articles 8, 9 and 13, on withdrawal, legal guarantees and mediation, apply only to consumers within the meaning of the French Consumer Code.
4. Prices
Prices are shown in euros, excluding delivery costs, which are displayed before the order is confirmed.
The applicable price is the one displayed at the time of the order. We may change our prices at any time, with no effect on orders already placed.
5. Ordering
An order runs as follows: selecting the items, checking the summary, accepting these terms, paying. The order becomes firm on payment, and you receive confirmation by e-mail.
We may decline an order that is abnormal, manifestly fraudulent, or impossible to fulfil — in particular where a requested frame is no longer available in the version ordered. In that case you are informed and refunded in full.
6. Payment
Payment is made:

by card, through Stripe. We neither see nor store your card details;

by bank transfer, to the details supplied with the invoice;

in cash or by any other agreed means, for services paid for at the workshop.
Workshop services on equipment entrusted to us begin once payment is made or the quotation is accepted in writing.
7. Delivery
Areas. Mainland France and international.
Methods. Colissimo or La Poste, Mondial Relay pick-up point, or collection at the workshop at no charge.
Times. Unless stated otherwise on the product page, orders are dispatched within ten working days. A workshop service runs from the arrival of your equipment at the workshop, not from the order.
Delay. If the stated time is exceeded, you may ask us to deliver within a further reasonable period; failing performance, you may cancel the order and be refunded within fourteen days.
On arrival. Check the parcel on delivery. In case of damage or a missing item, record reservations with the carrier and tell us: we can only act if we are told.
8. Right of withdrawal
If you are a consumer, you have fourteen days from receipt of the goods — or from conclusion of the contract for a service — to withdraw, without giving a reason and without penalty.
How. Tell us through the contact form, or using the model form reproduced at the end of these terms. Any unambiguous statement will do.
Return. You return the goods within fourteen days of your declaration, at your own cost, in a resaleable condition: unused, complete, in their original packaging. A string whose packaging has been opened, or a racquet that has been strung or played with, does not meet that condition.
Refund. We refund everything you paid, including standard delivery costs, no later than fourteen days after recovering the goods, using the same means of payment as the order.
The exceptions, and they matter here. The right of withdrawal does not apply to:

goods made to your specifications or clearly personalised — a racquet set to order in mass, balance, swingweight, grip size or length, a paintjob, a custom-printed handle;

services fully performed before the end of the period, where you expressly requested immediate performance and acknowledged losing your right of withdrawal — a fitted string cannot be unfitted;

sealed goods that cannot be returned for hygiene reasons, such as opened grips and overgrips.
That is the other side of made-to-measure: we do not build in advance, so we do not take back what was made for you alone.
9. Legal guarantees
We owe the statutory guarantees, whatever may be written elsewhere.
Legal guarantee of conformity. You have two years from delivery of the goods to act. It entitles you to repair or replacement of the goods and, failing that, to a price reduction or cancellation of the sale. You do not have to prove the defect: for twenty-four months it is presumed to have existed on the day of delivery. This guarantee applies irrespective of any commercial warranty.
Guarantee against hidden defects. You may also act under articles 1641 et seq. of the French Civil Code, within two years of discovering the defect, to obtain cancellation of the sale or a price reduction.
What those guarantees do not cover — and this is physics, not a clause. A string is a wear part: it loses tension from the moment it is fitted and it breaks in play. Breakage, tension loss, grip wear and impact marks are not defects of conformity. Nor is damage caused by impact, misuse, modification by a third party, or normal wear.

10. Liability
Our products are intended for playing tennis. We are not liable for damage resulting from improper use, from a modification made after the sale, or from failure to follow the instructions supplied with a service.
Equipment entrusted to us for a service is covered while it is at the workshop. A carbon frame repair restores a usable structure, not a new frame: it is carried out to professional standards, without a guarantee of long-term behaviour, and this is restated on the quotation.

12. Intellectual property
All content on the site — text, photographs, diagrams, calculation modules, range names — is protected. Reproduction or reuse without written permission is prohibited.
13. Complaints, mediation and governing law
Write to us first. Most disputes are settled in a single message: contact form.
Mediation. If our answer does not satisfy you, you may use a consumer mediator free of charge within one year of your written complaint.
Governing law. These terms are governed by French law. If you are a consumer resident in the European Union, you keep the benefit of the mandatory provisions of the law of your country of residence.
14. Changes
We may amend these terms. The version applicable to your order is the one in force on the day you place it.
